If a regulator or platform asks how you verify age, "we have their birthdate on file and it gates account creation" is a real answer. "We have a checkbox" is not.
What email service providers actually allow
Most mainstream ESPs, Mailchimp, Constant Contact, HubSpot, prohibit cannabis product marketing in their terms of service, even where cannabis is state-legal. This trips up a lot of dispensaries who sign up, build a list, and then get suspended mid-campaign. Cannabis dispensaries carry the same TCPA obligations as anyone else, plus the state-level age verification layer on top. A compliant SMS program needs: explicit opt-in language at signup that mentions message frequency and that message/data rates may apply, a working STOP keyword, and records showing consent was collected, not assumed.
Loyalty program structure and discounting rules
Points-based loyalty programs are generally fine across Nevada, California, and Arizona, but the discounting mechanics need a second look. Nevada in particular scrutinizes promotions that function as disguised free giveaways, "buy one get one free" style offers can trigger additional compliance review depending on how they're structured. The safer pattern is a straightforward points-per-dollar system redeemable for a percentage off, which reads clearly as a loyalty discount rather than a promotional giveaway.
- Keep language around rewards factual: "earn points, redeem for discounts," not "free products" or health-adjacent claims like "earn your wellness rewards."
- Don't tie loyalty perks to referral incentives that could read as testimonial-style endorsement without a release on file.
- Keep a compliance-reviewed template for any tiered "VIP" messaging, since higher-tier communications tend to get more promotional over time if nobody's checking.
What this actually adds up to
A dispensary that can't run Google or Meta ads but has a well-built loyalty program, a clean age-gated email list, and a compliant SMS channel usually outperforms one that's still trying to find workarounds for paid social. The channels are less flashy, but they're the ones you actually control end to end, from signup to send to compliance record. Build the age gate right, pick a platform whose terms actually allow cannabis, and keep your discounting language clean, and this becomes your most reliable acquisition channel rather than your riskiest one.
